.@BFFEIN: overstaying a visa isn't a crime, it's a civil infraction. Simply being here illegally isn't necessarily a crime. People who didn't have visas have been prosecuted for illegal entry. Implying otherwise as @caroljsroth does plays into the hands of the pro-amnesty side.
